Referral Monster — Terms of Service

These Terms of Service ("Terms") govern your use of Referral Monster Discord Bot (the “Bot”). By inviting or using the Bot, you agree to these Terms. If you do not agree, you must not use the Bot.

1. Operator

2. Eligibility

You may use the Bot only if you comply with:

Discord’s Terms of Service and Community Guidelines
Applicable laws in your jurisdiction
These Terms

Server owners and administrators are responsible for ensuring that their use of the Bot is lawful and appropriate for their communities.

3. Free Access and Future Paid Plans

The Bot is currently provided free of charge.
If the Bot is validated by Discord and transitions to a paid service, servers that invited the Bot before the transition date will retain free access indefinitely.
Future users (servers inviting the Bot after the transition date) may be required to subscribe to a paid plan.
We reserve the right to define paid features, subscription terms, and billing conditions at the time of transition.

4. Acceptable Use

You agree not to use the Bot for:

Any unlawful activity or violation of Discord’s rules
Spam, harassment, or abuse of other users
Attempting to gain unauthorized access to the Bot, its database, or infrastructure
Reverse-engineering or reselling the Bot’s services

We reserve the right to suspend or terminate access to the Bot at any time, with or without cause, at our sole discretion. This may apply to individual users, specific servers, or the service as a whole.

5. Service Availability

The Bot is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted availability, error-free performance, or that the Bot will meet your specific requirements.
We may update, modify, or discontinue functionality at any time.

6. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages (such as loss of data, loss of profits, or server downtime), except where such exclusion is not permitted by law.
Our total liability for any claim is limited to the greater of (i) the amount you paid for the service in the past 90 days. For free users, liability is €0.

7. Data Processing

Use of the Bot is subject to our Privacy Policy. The Privacy Policy explains what data is processed, stored, and how users can exercise their rights under GDPR.

8. Termination

You may stop using the Bot at any time by removing it from your server.
We may suspend or terminate service for violations of these Terms, security issues, or legal reasons.

9. Governing Law

These Terms are governed by the laws of Italy and applicable European Union law.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Milan, Italy.

10. Changes to These Terms

We may update these Terms to reflect changes in service or legal requirements. Material changes will be indicated by updating the effective date. Continued use of the Bot after changes indicates acceptance of the updated Terms.
